These Terms and Conditions apply only in the United States. By using this site, you swear and affirm that you are over the age of 21. Without exception, every person using the site or receiving a shipment of alcoholic beverages must be over the age of 21. THESE TERMS ARE AN ENFORCEABLE CONTRACT BETWEEN YOU AND NAKED WINES THAT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY. YOU AND NAKED WINES AGREE TO RESOLVE DISPUTES BY INDIVIDUAL ARBITRATION OR IN SMALL CLAIMS COURT ONLY, AND TO GIVE UP ALL RIGHTS TO (A) A JURY TRIAL OR (B) PARTICIPATION IN ANY CLASS ACTION. When you give Nakedwines.com your credit or debit card details, you are confirming that you are the card holder or have permission from the card holder to use the card on this website. For your own safety, we reserve the right to contact your card issuer for the purposes of carrying out security checks. If you add two or more credit cards to your Nakedwines.com account, and we are unable to charge your default credit card for an order you’ve placed, we will next attempt to charge the other credit card(s). By adding multiple credit cards to your Nakedwines.com account, you authorize this practice. Account registration data, as well as any personal or other information that you provide this site is governed by our Privacy Policy.

We reserve the right to cancel any orders that cannot be fulfilled for any reason. If your order is cancelled, we will contact you to explain why and refund any money you have paid us for that order.

Nakedwines.com makes every effort to ensure that the information on this website is accurate and current. Nakedwines.com, however, provides this website and its contents on an "as is" basis and makes no, and expressly disclaims all, representations and warranties of any kind with respect to this website and its contents.

Nakedwines.com reserves the right to change price and availability information without notice. Nakedwines.com shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or discount, or containing any other incorrect information or typographical errors.

All of our wines are covered by our 100% hassle-free guarantee.  We want you to enjoy the wines you buy from us - so, if you tell us a wine was faulty, or just not to your taste, we’ll add a credit to your account for you to put towards another order.  This credit can only be used to buy products on our website and is not redeemable for cash.  In the event we determine, in our sole discretion, that a customer is using this guarantee in a manner that is excessive or abusive, we reserve the right to revoke the guarantee for that customer with respect to future purchases.

Nakedwines.com's website may contain links to other websites or resources. You acknowledge and agree that Nakedwines.com is not responsible or liable for (1) the availability or accuracy of such websites or resources, or (2) the content, advertising, or products on or available from such websites or resources. The inclusion of any link on the Nakedwines.com website does not imply that Nakedwines.com endorses the linked site.

We reserve the right to suspend, terminate, or revoke access to your account at any time for legitimate business reasons, including where you breach these Terms and Conditions, misuse the service, or where required by law. Where reasonably practicable, we will provide you with notice of termination. However, we may suspend or terminate your account immediately and without notice where we reasonably believe this is necessary to protect our service, other users, or to comply with legal obligations.

We may update these terms from time to time to reflect changes in law, regulatory requirements, or how we operate our services. If we make a change that is material, we will provide you with reasonable advance notice, including details of the change and when it will take effect. The most current version of these terms will always be available on our website, and any updates will apply from the effective date stated in the notice or, if no date is stated, from the date they are published.

Permission is granted to electronically copy and to print in hard copy portions of this site for the sole purpose of using this website as a shopping resource. Any other use of materials on this website without the prior written permission of Nakedwines.com is strictly prohibited.

We currently ship to the mainland United States, plus Hawaii and Alaska, except for Delaware, New Jersey, Rhode Island, and Utah. We deliver only to people aged 21 and over. You will need to show a valid ID to receive your shipment. We aim to deliver to the mainland United States in 2-6 business days. Depending on the total cost of your order and your mainland delivery state, shipping may be included in the price of your purchase or be an additional charge, typically $9.99. We will make clear before you make your purchase whether shipping is included or subject to an additional charge and the amount of any additional charge. We aim to deliver to Alaska and Hawaii in 2-4 business days. Shipping to Alaska typically costs $130 per package and shipping to Hawaii typically costs $70 per package. We will make your shipping cost clear before you make your purchase. We do our best to make sure shipments arrive quickly and in good condition. For that reason, if the weather is too hot or too cold, we may delay shipment until conditions are more favorable. We will keep you notified if this happens. If your order goes missing or is damaged between dispatch and delivery, we will send you a replacement order as soon as we can. If we are unable to dispatch replacement goods within 7 days, we will offer you a full refund.

If you're not happy with the wine, the service or anything else, just email us at chat@nakedwines.com or call us at 1-800-673-4718 and we will credit your Nakedwines.com account with the price you paid. As a general rule, we will require you to return the wine you haven't yet consumed. If you would prefer to be credited through some other means, you must tell us at the time of your request. If we feel that you are taking advantage of us, we reserve the right to close your account and banish you from Nakedwines.com for ever and ever.

Any Nakedwines.com promotions, discounts or vouchers are single use only and not to be used in conjunction with any other promotion, discount or voucher, unless otherwise stated. Any promotional credits applied to your account will expire twenty-four months after the date of issuance. If you are lucky enough to receive one of our discount vouchers, here's how they work:

1. Before you start spending, you have to register with us, which includes providing your credit/debit card details and delivery information. The discount vouchers are for first time customers only, and it's one voucher per person. (Sadly, we can't give wine away!)

2. You can register and redeem the voucher online, but if you have any problems or issues, you can call 1-800-673-4718 or email chat@nakedwines.com

3. You must be 21 years of age or older to redeem your voucher.

4. A minimum purchase value and purchase bottle number is required to redeem your voucher, e.g., to redeem a $100 voucher, we may require you to purchase 6, 9, 12, or 15 bottles at a minimum $160 value. We will make the required purchase value and purchase bottle number clear on your voucher and/or at the time of purchase.

5. The voucher discount is distributed evenly among all of the wines included in your purchase.

6. If you redeem your voucher for certain introductory offers, you may be enrolled in one of our subscription products.  We will make this clear before you complete your purchase.

7. There may be some wines that the vouchers cannot be used against, but we'll make it clear when that is the case. There are also some states where we can't redeem the vouchers. Again, we'll make it clear when that is the case.

8. Be sure to read the terms and conditions on the promotion carefully. We operate on a fair use policy. We honor promotions honestly obtained, but reserve the right to close your account(s!) if we suspect that you are downloading promotions from a promotion site or otherwise reproducing them, even if you set up multiple accounts in the names of your pet hamsters. It is just not fair to us or our other customers.

9. The promotional value is not refundable and the offer is not redeemable for cash.

10. Alcoholic beverage industry members are not eligible.

11. Our vouchers are void where prohibited. $20 Welcome Credit

The $20 Welcome Credit ("Welcome Credit") is added to your account after your first monthly payment is transferred to your Angel account. The Welcome Credit will expire twenty-four months after the date of issuance.

1. You can use the Welcome Credit towards your second order as an Angel member. The Welcome Credit will be applied towards the subtotal of your purchase, before delivery and sales tax.

2. The Welcome Credit may not be applied towards a monthly Angel payment or towards the purchase of a gift certificate.

3. The Welcome Credit is for first time Angel customers only. If you cancel your Angel account and then sign up for a new account, you are not eligible to receive the Welcome Credit.

4. The Welcome Credit is not redeemable for cash and the promotional value is non-refundable. If you cancel your Angel account after the Welcome Credit is received and without making a second purchase, you will not receive the Welcome Credit as part of your Angel deposit refund.

5. The Welcome Credit is void where prohibited.

If you post a comment on any of the public walls around the site, or provide a product review or rating, your comments will be in the public domain and therefore will be visible to anyone who visits the site. Therefore, please don't say anything embarrassing, nasty or private. Users may access their Naked Me page to update or delete their personal information and change their privacy settings. To do this, simply log into the Naked Me section of the website and edit your profile. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information relevant to the site (“Submissions”), provided by you on the site regarding Nakedwines.com, its affiliated companies or partners are non-confidential and Nakedwines.com, its affiliated companies and partners will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.

Nakedwines.com neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on the Nakedwines.com website by anyone other than authorized Nakedwines.com's employees acting in their official capacities.

You become an Angel by agreeing to save at least $40 into your Nakedwines.com Angel Account ("Angel Account") towards your next order, yours to spend on any wines available in your state whenever you want. Your Angel funds are not refundable or redeemable for cash.

In return for your support of the Angel program, you get preferential pricing of up to 60% off of Nakedwines.com's already great prices every time you order (i.e., you pay the Angel Price rather than the Market Price listed next to each product). There are a handful of highly-discounted wines for which there is no additional Angel discount, which we will make clear.

How Your Angel Account Works.

Your first payment will be transferred from your registered credit or debit card when you become an Angel and monthly payments will be transferred from your registered credit or debit card on or around that date each month that you continue being an Angel (you can change your payment date on your Account page).

By signing up to be a Naked Angel — either by purchasing our introductory offer or through other means — you authorize Nakedwines.com to make recurring periodic charges to your card, as described above, without further authorization from you until you cancel your Angel membership.

Your Angel Account balance will be used to make purchases in accordance with a “First-In First-Out” (“FIFO”) method, meaning the first-added or oldest funds will be used first to make any purchases on our site and will be withdrawn first in the event we return some, but not all, of your Angel Account balance to you. If you place an order that totals more than the balance in your Account, then we will charge your registered debit/credit card for the difference.

Every two years, on or around February 28, if your Angel Account reaches a balance of $80 or more and you have not placed a qualifying order during the preceding twenty-four (24) months, we will automatically apply your Angel funds towards the delivery of a curated case of wine to the last-known delivery address on your Angel Account. We will provide advance notice prior to such delivery. During the notice period, you may elect to place a qualifying order, update your delivery preferences, or opt out of the automatic delivery.

If you don't like a wine, or it's corked or damaged, we'll add a credit to your account to try something else. Email us at chat@nakedwines.com or call us at 1-800-673-4718 and we'll sort it out for you.

Promotions, including discount vouchers, are only redeemable against the standard price, not the Angel price, unless otherwise stated. Promotional funds may not be applied towards a monthly Angel payment. There is no Angel discount when buying a gift certificate and Angel funds may not be applied to buying a gift certificate.

A minimum purchase is required to claim your Angel "gift" bottle. Your gift bottle is included in the price of your purchase. The discount attributable to the gift bottle is distributed evenly among all of the wines included in your purchase.

Your participation as a Naked Angel entitles you only to the benefits listed in these Terms and Conditions. You are not entitled to any interest whatsoever in any winery, winemaker, or other enterprise.

Cancelling Your Angel Account. If you cancel your Angel membership or your monthly contributions stop, other than where you have opted for a temporary monthly payment holiday, any unspent Angel funds will expire twenty-four (24) months after the date of cancellation. At the time your membership is cancelled or payments cease, you may choose to apply any unspent Angel funds to place a final order of wine that exhausts the remaining unspent funds.

You may cancel your Angel Account at any time by visiting the Angel Account section of your Account page, calling us at 1-800-673-4718 or emailing us a chat@nakedwines.com. If you cancel your Naked Angel account, you will no longer be entitled to Angel privileges like preferential pricing and other Angel-only offers.

Our Never Miss Out program allows you to request to reserve your favorite wines in advance of their release. As you know, our wines are popular and sometimes your favorites sell out fast! We do not offer this program in all states or for all of our wines, and not all of our wines are available in all states.

You’ll tell us how many bottles of a particular wine you would like each vintage. In general, we allow you to select 6, 9, 12 or 15 bottles. We reserve the right to offer fewer or different bottle number selections in different states. When the wine is complete and on its way to our warehouse, we’ll send you an email letting you know that the wine will be shipped to you shortly. Your credit card will not be charged until the wine is on its way to you. Certain states restrict the volume of wine you may have delivered to you. If you exceed the volume limitation in your state with your Never Miss Out order, we will have to cancel your order. If that happens, we will inform you by email and your credit card will not be charged.

We reserve the right to adjust the price of the wine at any time and for any reason. If we raise the price of the wine above the price listed at the time you ordered, we will inform you by email and you will have the opportunity to cancel your order. If the wines you have selected are not available for a particular vintage, we may offer you equivalent wines. If that is the case, we will inform you by email and you will have the opportunity to accept or reject our proposed substitution. You may cancel your subscription at any time by calling us at 1-800-673-4718 or emailing us atchat@nakedwines.com

Wine Genie is a wine subscription service, where we select wine for you based on your preferences and ship it to you on a recurring basis. You'll tell us how many bottles of wine you would like — 6, 9, 12 or 15 bottles — and how often you would like to receive wine — every 1, 2 or 3 months. We reserve the right to offer fewer or different bottle number selections and fewer or different shipping frequency options in different states. We do not offer this program in all states or for all of our wines, and not all of our wines are available in all states.

You'll also tell us what types of wine you like and your preferred price range. We will craft a selection of wines just for you based on your preferences. When your selection is ready, we will notify you by email and you will have the opportunity to substitute different wines for the wines we've selected or to cancel your order. If you take no action with respect to your selection within the time period specified in the email, you will be deemed to have accepted the selection and the wine will be shipped to you.

Your credit card will not be charged until the wine is on its way to you. Certain states restrict the volume of wine you may have delivered to you. If you exceed the volume limitation in your state with your Wine Genie order, we will have to cancel your order. If that happens, we will inform you by email and your credit card will not be charged.

These SMS Terms of Service (the “SMS Terms”) govern the provision, receipt, and delivery of text messages by or on behalf of Nakedwines.com, including our subsidiaries and other affiliates (collectively, “Nakedwines.com,” “we,” “us,” or “our”). Depending on the consent you’ve provided, our text messages (the “Naked Wines Texts”): (i) notify you about your account; (ii) provide you updates on the status of your order and/or delivery; (iii) address an outstanding payment or debt; and/or (iv) contact you about exclusive offers and for any other marketing or promotional purposes.

E-SIGN Disclosure and Agreement By providing your consent to receive Naked Wines Texts (as described below), you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by emailing us at chat@nakedwines.com with “Revoke Electronic Consent” in the subject line.

To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. Agreement and Consent to Receive Naked Wines Texts You can provide us with your consent to receive Naked Wines Texts in multiple ways, such as by providing us with your phone number when inquiring about our products or services, sending a text message to us, through communications or transactions with us, or by opting into receiving marketing Naked Wines Texts. We may offer multiple Naked Wines Texts programs, and you may provide consent to more than one Naked Wines Texts program. By providing your consent, you understand we may send you texts even if your number is registered on a state or federal Do Not Call list. You further agree to these SMS Terms, Nakedwines.com Terms and Conditions, and Nakedwines.com Privacy Policy.

By providing consent, you authorize us to use automated or nonautomated technology to make calls or send Naked Wines Texts to the number associated with your consent. You may opt into receiving Naked Wines Texts and calls with marketing content, and consent to receiving marketing texts or marketing calls is not a condition of purchase. Message frequency varies.  We may send you an initial message confirming your enrollment in Naked Wines Texts. After that, you will receive recurring text messages, and the specific amount may vary depending on how you use our services (e.g. whether you reply with HELP, the number of times you’ve requested information from Naked Wines, such as information about products or services available through Naked Wines, the number of Naked Wines Texts programs you have enrolled in).

Eligibility By consenting to receive Naked Wines Texts, you represent that you are 21 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms. You further represent that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and for which you are authorized to opt into Naked Wines Texts.

Costs of Naked Wines Texts and Participating Carriers Message and data rates may apply. Please contact your mobile phone carrier for details. Nakedwines.com is not responsible for any SMS messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number. Naked Wines Texts are supported on all U.S. carriers. The supporting mobile carriers may change without notice, and the particular Naked Wines Texts program you join, including those operated through a different number, may be limited to specific carriers. Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Nakedwines.com, its service providers and the mobile carriers (including T-Mobile) supported by the program are not liable for delayed or undelivered messages. 

Opting out of Naked Wines Texts You may opt out at any time by contacting us at chat@nakedwines.com or 1-800-673-4718 with your opt out request and the phone number for which you request to opt out of Naked Wines Texts. You may also text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode or phone number you may receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Nakedwines.com and its service providers will have no liability for failing to honor such requests. You must separately opt out of each number from which you’ve provided us with consent to receive Naked Wines Texts. If you have consented to multiple Naked Wines Texts programs, you must also separately opt out of each program.

Modifications We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in Naked Wines Texts shall be deemed to constitute acceptance by you of such modifications, additions, or deletions.

YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND NAKEDWINES.COM (WHETHER OR NOT SUCH DISPUTE INVOLVES A THIRD PARTY) WITH REGARD TO YOUR RELATIONSHIP WITH US, INCLUDING WITHOUT LIMITATION DISPUTES RELATED TO THESE TERMS AND CONDITIONS, YOUR USE OF OUR SITE OR APP, YOUR PURCHASE OF OUR PRODUCTS OR SERVICES, AND/OR RIGHTS OF PRIVACY AND/OR PUBLICITY, WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION'S RULES FOR ARBITRATION OF CONSUMER-RELATED DISPUTES AND YOU AND WE HEREBY EXPRESSLY WAIVE TRIAL BY JURY. DISCOVERY AND RIGHTS TO APPEAL IN ARBITRATION ARE GENERALLY MORE LIMITED THAN IN A LAWSUIT, AND OTHER RIGHTS THAT YOU AND WE WOULD HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION. As an alternative, you may bring your claim in your local "small claims" court, if permitted by that small claims court's rules and if within such court’s jurisdiction, unless such action is transferred, removed or appealed to a different court. You may bring claims only on your own behalf. Neither you nor we will participate in a class action or class-wide arbitration for any claims covered by this agreement to arbitrate. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. You also agree not to participate in claims brought in a private attorney general or representative capacity, or consolidated claims involving another person's account, if we are a party to the proceeding. This dispute resolution provision will be governed by the Federal Arbitration Act and not by any state law concerning arbitration. In the event the American Arbitration Association is unwilling or unable to set a hearing date within one hundred and sixty (160) days of filing the case, then either we or you can elect to have the arbitration administered instead by the Judicial Arbitration and Mediation Services. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction. Any provision of applicable law notwithstanding, the arbitrator will not have authority to award damages, remedies or awards that conflict with these Terms and Conditions.

Your use of the Nakedwines.com website is at your own risk and you assume full responsibility for all costs associated with all necessary servicing or repair of any equipment you use in connection with your use of the website. Nakedwines.com and its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the Nakedwines.com website. In no event shall Nakedwines.com and/or its suppliers be liable for any indirect, punitive, incidental, special or consequential damages, or any damages whatsoever, including, without limitation, damages for:

• loss of use, data or profits, arising out of or in any way connected with the Nakedwines.com website;

• the use or performance of the Nakedwines.com website;

• the delay or inability to use the Nakedwines.com website;

• the provision of or failure to provide services;

• any events, information, software, products, services or related graphics obtained through the Nakedwines.com website; or

• any claim otherwise arising out of the use of the Nakedwines.com website

whether based on contract, tort, negligence, strict liability or otherwise, even if Nakedwines.com or any of its suppliers has been advised of the possibility of damages. If you are dissatisfied with any portion of the Nakedwines.com website, or with any of these Terms of Service, your sole and exclusive remedy is to discontinue using the Nakedwines.com website. This sole and exclusive remedy is separate and independent of any other provision that limits Nakedwines.com's liability or your remedies.

Nakedwines.com shall be excused from performance under these Terms of Service if Nakedwines.com is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement by reason of: (a) any provision of any present or future law or regulation or order of the United States of America, or any state thereof, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Nakedwines.com.

The Terms of Service, along with the Privacy Policy, compromise the entire agreement between you and Nakedwines.com. Any attempt by you to assign, transfer or delegate these Terms of Service are personal to you and you may not transfer, assign, or delegate them without approval from Nakedwines.com. California law and controlling U.S. federal law, without regard to the choice or conflicts of law provisions of any jurisdiction, will govern any action related to these Terms of Service. You agree to submit to the jurisdiction of the courts located in San Francisco or Napa County, in the State of California, for the resolution of all disputes arising from or related to these Terms of Service and/or your use of the website.

For the person sending an invite. Every Angel is invited to send a welcome deal to their friends who don't currently shop with Naked Wines, via email, Facebook and Twitter. This deal may vary, but you can find the details via the 'Invite a friend' link in the menu once logged-in, or by visiting www.nakedwines.com/invitefriends.

You can send the deal to as many friends as you like, as often as you like, but your friends will only be able to redeem the deal if they're new to Naked Wines. By inviting a friend, you confirm that you have their consent for us to email them their offer code, plus one reminder. They have 30 days to claim - after that, we’ll delete their data. If your friend decides to take up the deal, they're under no obligation to buy again or become an Angel (but we will invite them to become one!). For every friend that orders off the back of your invite, we will credit your Naked Wines account with credit as soon as their order is shipped. The credit is not refundable and expires twenty-four months after the date of issuance. Void where prohibited. Additional restrictions apply and vary by state.

Naked Wines reserves the right to withdraw or revoke the credit offer or change the amount of the credit at any time, if it determines that the 'Invite a friend' deal is being abused or it is appropriate to do so.

For the person receiving an invite. If you're new to Naked Wines, you're welcome to redeem any 'Invite a friend' deal sent to you by an existing Naked Wines customer. The offer can only be redeemed one-time. If you have been invited, we'll send you an email with an offer, and one further email reminder. If you don't claim the offer, we'll remove your information from our database after 30 days. The offer cannot be used in conjunction with any other offer or voucher. If you do decide to order and you don't like the wines, our hassle-free guarantee still applies - just let us know and we'll add a credit for the price paid to your account for you to put towards another order.
